Terms of Service

These Terms of Service ("Terms") govern your use of the OMOI mobile application and related services operated by Clever Crow Labs.

By using OMOI, you agree to these Terms. If you do not agree to these Terms, you should not use OMOI.

1. Eligibility

You must be legally capable of agreeing to these Terms or have the permission of a parent or legal guardian where required by applicable law.

If you use OMOI on behalf of another person or organization, you represent that you have authority to do so.

2. Account Registration

Some OMOI features require an account.

You are responsible for:

• maintaining access to the authentication method associated with your account
• keeping your device reasonably secure
• maintaining the confidentiality of any OMOI PIN you create
• activity performed through your account or device

You should provide accurate information when creating or maintaining your account.

OMOI may support authentication through email, Google Sign-In, Apple Sign-In, or other supported authentication providers.

3. Personal Journal Content

Users retain ownership of the journal content they create.

This may include journal text, photos, audio recordings, tags, companion names, moods, scores, and other information users choose to include in their journal.

Users grant Clever Crow Labs only the limited rights necessary to:

• store content
• synchronize content
• display content back to the user
• restore entries
• provide requested OMOI features
• maintain and secure the service

This limited permission does not transfer ownership of journal content to Clever Crow Labs.

The permission ends when the relevant content and account are permanently deleted, except where limited retention is required for legitimate technical, security, legal, or service-provider purposes.

4. User Responsibility for Content

Users are responsible for the content they create, upload, record, or otherwise provide through OMOI.

Users should not use OMOI to store or distribute content that violates applicable law or another person's rights.

If journal entries contain information about other people, including companion names, users are responsible for deciding whether it is appropriate and lawful to record that information.

5. Acceptable Use

Users must not:

• use OMOI for unlawful purposes
• upload malware or malicious files
• attempt unauthorized access to accounts, systems, or infrastructure
• interfere with the operation or security of OMOI
• abuse cloud storage or other service resources
• violate another person's intellectual property, privacy, or legal rights
• use the service in a way intended to damage, disrupt, overload, or exploit OMOI or its service providers

OMOI is intended primarily for personal journaling and reflection.

6. Sensitive Information

Users choose what they write, record, or upload to OMOI.

Users should carefully consider before recording highly sensitive information such as:

• passwords
• financial account information
• government identification numbers
• confidential information belonging to another person
• information that could create personal safety or security risks

OMOI provides security features, but no digital storage system can guarantee absolute security.

7. Cloud Sync and Availability

OMOI may provide cloud synchronization and restoration through third-party infrastructure.

Cloud synchronization is intended to help users access or restore supported journal information, but users should not assume that any digital service is completely immune to:

• outages
• synchronization failures
• data corruption
• account-access problems
• device failure
• network interruptions
• third-party service interruptions
• software defects

Users are encouraged to periodically use OMOI's Export / Import functionality if they want to maintain an additional portable copy of important journal information.

8. Export and Import

OMOI may allow users to export and import journal information.

Exported files may contain private or sensitive journal content.

Once an exported file leaves OMOI's controlled app storage, the user is responsible for deciding where the file is stored, copied, uploaded, transmitted, or shared.

Users should protect exported journal files appropriately.

Clever Crow Labs cannot control copies that users independently store or share outside OMOI.

9. Reminders

OMOI may provide optional journal reminder notifications.

Reminder delivery may be affected by factors outside OMOI's control, including:

• device settings
• battery optimization
• notification permissions
• operating-system restrictions
• timezone changes
• device shutdown
• manufacturer-specific background restrictions

OMOI does not guarantee that every reminder will arrive at an exact time.

Reminders must not be relied upon for emergencies, medical treatment, medication schedules, legal deadlines, financial deadlines, or other critical obligations.

10. Health and Professional Disclaimer

OMOI is a journaling and reflection application.

OMOI is not:

• medical advice
• mental-health treatment
• therapy
• diagnosis
• crisis support
• legal advice
• financial advice

Features such as mood tracking, daily scores, journal insights, averages, or other reflection tools are provided for personal journaling purposes and should not be interpreted as professional assessments.

Users should seek qualified professional assistance when appropriate.

11. Voice-to-Text and Device Services

OMOI may provide optional voice-to-text functionality using speech-recognition services available through the user's device, including services provided by Google or other device speech providers.

The availability, accuracy, processing, and performance of speech recognition may depend on the user's device, operating system, language, network connection, and third-party provider.

Clever Crow Labs does not guarantee the accuracy of speech recognition.

Users should review transcribed text before relying on or saving it.

12. Weather Information

OMOI may provide optional weather information for journal entries.

Weather information may be obtained using third-party services, including approximate IP-based location information and weather-data providers.

Weather information is provided for general journaling context only.

Clever Crow Labs does not guarantee that weather information will always be available, current, complete, or accurate.

Weather information should not be relied upon for safety-critical decisions.

13. OMOI Plus and Future Paid Features

OMOI may introduce optional paid features, purchases, or subscriptions in the future.

No paid OMOI Plus subscription is currently required to use the features available in this version of OMOI.

If paid features are introduced in the future, applicable pricing, billing periods, renewal terms, cancellation options, trial terms where applicable, and other purchase information will be presented to users before purchase.

Any future purchases made through Google Play will also be subject to applicable Google Play terms and policies.

These Terms may be updated when paid functionality becomes available.

14. Third-Party Services

OMOI relies on third-party services to provide certain functionality.

These may include:

• Supabase for authentication, databases, cloud synchronization, media storage, and account-management infrastructure
• Google for Google Sign-In and device or Google speech-recognition services
• Apple for Apple Sign-In where available
• ipapi.co for approximate IP-based location used for weather functionality
• Open-Meteo for weather information
• Google Play for application distribution and services associated with Android applications
• Android operating-system services for notifications, biometric authentication, file selection, and other device functionality

Third-party services operate under their own terms, privacy policies, availability, and technical requirements.

Clever Crow Labs is not responsible for third-party services to the extent permitted by applicable law.

15. Security Features

OMOI may provide optional security features such as PIN protection and biometric authentication.

Users remain responsible for maintaining reasonable security of their device and authentication methods.

Biometric authentication depends on the device and Android operating system.

Security features are intended to provide additional protection but cannot guarantee that unauthorized access will never occur.

16. Changes to Features

OMOI may:

• add features
• modify features
• remove features
• change technical requirements
• change third-party service providers
• discontinue parts of the service

Where reasonably practical and legally required, significant changes may be communicated to users.

17. Suspension and Termination

Access to OMOI may be suspended or terminated where reasonably necessary because of:

• violation of these Terms
• security threats
• fraud
• unlawful activity
• abuse of the service
• attempts to interfere with OMOI infrastructure
• legal requirements
• discontinuation of the service

Users may stop using OMOI or delete their account at any time.

18. Account Deletion

Users may permanently delete their OMOI account using the account-deletion functionality provided by OMOI.

When account deletion successfully completes, OMOI is designed to delete the user's account and associated synchronized journal information and uploaded journal media from active OMOI cloud storage.

OMOI also removes account-specific journal data and settings stored locally by the application where applicable.

Account deletion is permanent and cannot be undone.

Users should export anything they wish to keep before deleting their account.

Limited information may remain temporarily where required for legitimate technical, security, legal, backup, or service-provider purposes.

Copies independently exported or stored by the user are not deleted by deleting the OMOI account.

19. Intellectual Property

The OMOI name, logo, application design, branding, software, website, and original materials are owned by Clever Crow Labs or its licensors, except for user-created content and third-party materials.

These Terms do not transfer ownership of OMOI intellectual property to users.

Users may not copy, reproduce, distribute, reverse engineer, or commercially exploit OMOI materials except where permitted by applicable law or with authorization from Clever Crow Labs.

Nothing in this section limits rights that cannot lawfully be restricted.

20. Disclaimer of Warranties

To the extent permitted by applicable law, OMOI is provided on an "as available" basis.

Clever Crow Labs does not guarantee that OMOI will always be:

• uninterrupted
• error-free
• completely secure
• compatible with every device
• available in every location
• free from data loss
• free from third-party service interruptions

Nothing in these Terms excludes warranties or consumer rights that cannot legally be excluded.

21. Limitation of Liability

To the maximum extent permitted by applicable law, Clever Crow Labs will not be liable for indirect, incidental, special, consequential, or punitive damages arising from or relating to the use of OMOI.

Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited by applicable law.

Mandatory consumer protections applicable in the user's jurisdiction remain unaffected.

22. Indemnification

To the extent permitted by applicable law, users may be responsible for losses or claims arising from serious misuse of OMOI, violation of these Terms, unlawful activity, or infringement of another person's rights.

This provision does not apply where prohibited by applicable consumer law.

23. Governing Law

These Terms are governed by the laws of Japan, without prejudice to mandatory consumer protections or other rights that may apply under the laws of the user's country or region.

24. Changes to These Terms

These Terms may be updated from time to time.

Material changes may be communicated through:

• the OMOI application
• the OMOI website
• another appropriate notice

Where required by law, additional consent may be requested.

Users should periodically review the current version of these Terms.
